This product design and specifications for this protective barrier enclosure testing booth are being provided by the Regents of the University of Minnesota as a free service to the community during this public health emergency subject to the following terms:

 

Regulatory Notice

Individuals or organizations that manufacture products utilizing this design and specifications (“You”) are solely responsible for obtaining all applicable regulatory requirements that apply to the manufacture of the protective barrier enclosure testing booth.  You are solely responsible for determining whether the manufacture,  distribution or sale of protective barrier enclosure testing booths manufactured using this design and specifications complies with all regulatory requirements, including, but not limited to with respect to use in the U.S., the May 1, 2020 letter from FDA to Manufacturers of Protective Barrier Enclosures (https://www.fda.gov/media/137584/download).  UNIVERSITY MAKES ABSOLUTELY NO WARRANTY OR REPRESENTATION THAT MANUFACTURE ACCORDING TO THE DESIGN AND SPECIFICATIONS WILL COMPLY WITH REGULATORY REQUIREMENTS.  UNIVERSITY FURTHER NOTES FOR YOUR CONSIDERATION THAT THE PROTECTIVE BARRIER ENCLOSURE MAY NOT QUALIFY FOR EUA DESIGNATION UNDER THE TERMS OF THE FDA LETTER, IN PART, BECAUSE THE DESIGN AND SPECIFICATIONS INCLUDE A FAN AND AIR FILTER.   THUS, IF YOU MANUFACTURE THE PROTECTIVE BARRIER AND ENCLOSURE TESTING BOOTH, YOU MAY NOT HAVE THE LIABILITY PROTECTIONS PROVIDED BY THE EUA.

 

Liability Notice

BY MANUFACTURING, DISTRIBUTING OR UTILIZING THIS DESIGN AND SPECIFICATION, YOU ASSUME ALL RISKS ASSOCIATED WITH SUCH USE AND AGREE TO HOLD HARMLESS AND WAIVE ANY ALL CLAIMS OF WHATEVER NATURE AGAINST THE UNIVERSITY, ITS OFFICERS, EMPLOYEES AND AGENTS, AND OTHER PERSONS OR COMPANIES WHICH MAY HAVE CONTRIBUTED TO THE DESIGN AND SPECIFICATIONS.  EXCEPT WHERE SPECIFICALLY PROHIBITED BY LAW, UNIVERSITY MAKES ABSOLUTELY NO WARRANTIES OF ANY KIND THE PRODUCT DESIGN AND SPECIFICATIONS.

 

Intellectual Property License

You are free to use, copy, and share this design and specifications, including for commercial manufacture, without payment of any fees or charges, and for the duration of the declared COVID-19 public health emergency only, but may not assert ownership in the design and specifications, ownership of which belongs to the University and/or the individuals who created the design. 

 

Governing Law

This license is governed by the laws of the state of Minnesota, without regard to its conflict of law principles.  The United Nations Convention on Contracts for the International Sale of Goods does not apply to this License.
